Selling on e-commerce marketplaces like Amazon, Flipkart, and Meesho has become one of the most popular ways for Indian entrepreneurs to reach customers across the country. However, this convenience comes with significant GST compliance obligations that every online seller must understand. Unlike traditional offline businesses, e-commerce sellers operate through digital marketplaces that automatically report transactions to tax authorities, making GST compliance more transparent and closely monitored.

This comprehensive guide explains the GST registration, TCS, and compliance requirements for Amazon, Flipkart, and Meesho sellers.

Is GST Registration Mandatory for Online Sellers?

One of the most common questions asked by new entrepreneurs is whether GST registration is compulsory for selling online. The answer is generally yes .

Under Section 24(ix) of the CGST Act, 2017, any person supplying goods through an e-commerce operator who is required to collect tax at source is required to be registered under GST from the first sale , regardless of turnover. This means that the standard threshold limits of ₹40 lakh for goods and ₹20 lakh for services do not apply to marketplace sellers.

Additionally, sellers on e-commerce platforms are not eligible for the composition scheme under Section 10(2)(d) of the CGST Act. This closes the option of paying tax at a concessional rate for online sellers.

Recent Relief for Small Sellers

The government has introduced some relief for small businesses selling goods through e-commerce operators. Under certain conditions, sellers may be exempt from GST registration if:

  • They sell within the same state (intra-state supply).
  • Their turnover remains below the threshold limit.
  • They are not dealing in notified restricted goods.
  • The state has enabled this provision.

However, many marketplaces still require GSTIN details because of their internal compliance policies.

TCS Under GST for E-Commerce Operators

Under Section 52 of the CGST Act, 2017, e-commerce operators like Amazon and Flipkart are required to collect Tax Collected at Source (TCS) on the net value of taxable supplies made through their platforms.

TCS Rate and Mechanism

  • The TCS rate is 1% (0.5% CGST + 0.5% SGST for intra-state sales, or 1% IGST for inter-state sales).
  • TCS is calculated on the net taxable value of supplies, which is the aggregate value of taxable supplies minus returns and cancellations.
  • The e-commerce operator deducts TCS from the seller's settlement amount before transferring the funds.
  • The operator files a monthly return, GSTR-8, reporting the TCS collected from each seller.

Claiming TCS Credit

The TCS deducted by the e-commerce operator is deposited with the government and appears as a credit in the seller's electronic cash ledger . Sellers can claim this credit in GSTR-3B to offset their GST liability. The TCS credit is reflected in the seller's GSTR-2A under the TCS credit section.

GST Return Filing for Online Sellers

Online sellers must file the following GST returns:

  • GSTR-1: Monthly or quarterly return for outward supplies. Sellers must report all sales made through e-commerce platforms, including the TCS deducted.
  • GSTR-3B: Monthly summary return and payment of tax. Sellers claim ITC and TCS credit in this return.
  • GSTR-9: Annual return for consolidation of all monthly returns.

Input Tax Credit for Online Sellers

Online sellers can claim ITC on GST paid for:

  • Packaging materials.
  • Raw materials.
  • Shipping and logistics services.
  • Marketplace commission and platform fees.
  • Advertising and marketing expenses.
  • Software subscriptions and tools.

However, ITC cannot be claimed on blocked credits under Section 17(5), such as personal expenses or goods lost or destroyed.

Common Compliance Mistakes

  • Delaying GST registration until after the first sale.
  • Failing to reconcile TCS deducted by the marketplace with the credit claimed in GSTR-3B.
  • Incorrect reporting of sales in GSTR-1, leading to mismatches with the marketplace's GSTR-8.
  • Claiming ineligible ITC.
  • Not filing returns on time, leading to late fees and interest.

Practical Compliance Checklist

  • Obtain GST registration before listing products on any marketplace.
  • Reconcile marketplace settlement reports with GSTR-1 and GSTR-3B every month.
  • Verify TCS credit in the electronic cash ledger and claim it in GSTR-3B.
  • Maintain proper documentation for all sales, returns, and cancellations.
  • File GST returns on time to avoid penalties.
  • Review ITC eligibility before claiming credit.

Conclusion

GST compliance is not optional for online sellers on Amazon, Flipkart, and Meesho. The mandatory registration requirement, TCS deduction, and monthly return filing obligations create a complex compliance landscape. Failure to comply can lead to penalties, blocked ITC, and even suspension of marketplace accounts.
